Terms of Service

1. Service Description

FlyTranslator provides screenshot translation, voice dictation translation, and text processing (comment, improve, summarize) using Google Gemini AI models. The Service is available as a macOS desktop application.

2. Account

• A Google account is required to use FlyTranslator.
• You may only maintain one account per person.
• You are responsible for all activity under your account.
• You must provide accurate account information.

3. Credit System

• The Service operates on a prepaid credit system.
• Credits are purchased in packages via Stripe.
• Credits are deducted per request based on the AI model used and the number of tokens processed.
• Credit costs may vary by request type (screenshot, audio, text) and model (speed vs quality).
• Credits do not expire.
• Credits are non-transferable between accounts.
• Prices are displayed excluding applicable taxes. Depending on your location, VAT or other taxes may be added at checkout.

4. BYOK (Bring Your Own Key)

• Eligible users may use their own Google Gemini API key.
• When using your own API key, no credits are deducted.
• You are solely responsible for the security and costs of your own API key.
• We store your API key locally on your device using encrypted storage (macOS Keychain). It is never transmitted to our servers.

5. Acceptable Use

You agree not to:

• Use automated tools, bots, or scripts to interact with the Service
• Reverse engineer, decompile, or disassemble the App
• Circumvent rate limits (30 requests per minute) or other technical restrictions
• Share, sell, or transfer your account to third parties
• Use the Service for any unlawful purpose
• Submit content that violates third-party rights

6. Intellectual Property

• Your content: You retain all rights to content you submit (screenshots, audio, text). We do not claim ownership of your content.
• Our app: FlyTranslator, including its code, design, and branding, is our intellectual property. These Terms do not grant you any rights to our intellectual property beyond using the App as intended.
• AI output: Translation results are provided for your use. We make no claim of ownership over AI-generated output.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind.

• We do not guarantee the accuracy, completeness, or reliability of any translation or text processing output.
• AI-generated content may contain errors. Do not rely on translations for critical, legal, medical, or safety-related purposes without independent verification.
• We do not guarantee uninterrupted or error-free service.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.

9. Billing & Refunds

• Credits are a prepaid usage balance for the Service. They have no cash value and cannot be withdrawn, exchanged, or converted to currency.
• Refund requests may be submitted within 14 days of purchase.
• Refunds are available only for unused credits (no translation requests made since purchase).
• Partially used credit packages are not eligible for refund.

10. Dispute Resolution

• If you have a billing concern, please contact us first at [email protected] before initiating a chargeback or dispute with your bank.
• We respond to all billing inquiries within 48 hours.
• We are committed to resolving issues fairly and promptly.

11. Termination

• By you: You may stop using the App at any time. To delete your account and data, contact us.
• By us: We may suspend or terminate your access if you violate these Terms. We will provide notice when reasonably possible.
• Upon termination, unused credits are forfeited unless termination was initiated by us without cause.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Oviedo, Asturias, Spain.
